TERMS AND CONDITIONS

This promotion is valid only during the Promotional Period (specified below), and is subject to these Terms and Conditions, including without limitation, the eligibility and other requirements, terms, and conditions set forth herein. By participating in the promotion, you agree to be subject to and bound by these Terms and Conditions.

PROMOTIONAL PERIOD

The promotion runs from March 1, 2021, through February 15, 2022 (the “Promotional Period”).

THE OFFER

The following offer is made under the promotion (the “Offer”):

Qualified Purchasers (defined below) who purchase an Eligible Product (defined below) during the Promotional Period may receive a three (3) month license (the “Term”) for Boris FX Suite from Boris FX (https://www.borisfx.com) (the “License”).

The Boris FX Suite contains Boris FX’s Sapphire, Continuum, Mocha Pro, Silhouette and Optics products, as further described below:

• Continuum and Sapphire are plugin collections and do require a host application. Supported hosts include Adobe Premiere Pro and After Effects, Avid Media Composer, Blackmagic Resolve and Fusion, Foundry Nuke (Sapphire only), Autodesk Flame (Sapphire only), and VEGAS Pro.
• Mocha Pro is a plugin and standalone application. Popular Mocha Pro hosts include Adobe Premiere Pro and After Effects, Avid Media Composer, Blackmagic Fusion, Foundry Nuke, Autodesk Flame, and VEGAS Pro. Mocha Pro standalone can be installed on macOS, Windows, and Linux.
• Silhouette is primarily a standalone application, but also has a Paint plugin that is included in the installation. The plugin supports Adobe, Blackmagic, Nuke, Flame, and VEGAS Pro. Silhouette standalone can be installed on macOS, Windows, and Linux.
• Optics is a plugin for Adobe Photoshop and Lightroom. Optics also has a standalone application (included in the Optics installer) that supports macOS and Windows.

After the expiration of the Term, the License will automatically expire, and the Qualified Purchaser’s rights will be downgraded to a trial version of the Boris FX Suite (“watermarked mode”). In order to obtain full rights in the Boris FX Suite, the Qualified Purchaser must purchase a subscription or a new perpetual license for the Boris FX Suite from Boris FX.

Please review the “REDEMPTION” section below for more information regarding the Offer and how to receive the Offer.

ELIGIBLE PRODUCTS

The following Wacom products are eligible for the promotion (each an “Eligible Product”):

Wacom Cintiq Pro (Cintiq Pro 16, Cintiq Pro 24, Cintiq Pro 32), Wacom MobileStudio Pro (MobileStudio Pro 13, 16), and Wacom Intuos Pro (Intuos Pro S, M, L)

The promotion is limited to new products only. No used or refurbished products are eligible for the promotion.

QUALIFIED PURCHASERS

Those purchasers eligible for this promotion include individual end users, as follows (each a “Qualified Purchaser”):

Any end user purchaser of an Eligible Product having a place of residence in the Americas, i.e. the United States (and its territories or possessions), Canada, Central America, South America or the Caribbean.

Resellers, public entities, federal, state and local government entities, educational institutions, nonprofit organizations, enterprise purchasers, and business purchasers do not qualify.

You may be required to demonstrate that you meet the Qualified Purchaser requirements as a condition for receiving the Offer.

REDEMPTION

In order to redeem the Offer, you must comply with the following:

In order to receive the Offer, you must register your Eligible Product with Wacom at the following link: www.wacom.com/register.

Registration will be open on March 1, 2021, and must be completed in full no later than February 15, 2022 (“Registration Period”). Registration requires that you provide the following information: first and last name, country, a valid email address, and the serial number for the Eligible Product (normally detected automatically). You agree to provide accurate and complete registration information.

When registration with Wacom has been properly completed during the Registration Period, you will receive an email from Wacom confirming your registration. Your software release code for the License and a link to download the Boris FX Suite will be made available to you in your Wacom Library accessible via your Wacom account (https://account.wacom.com). The software release code must be redeemed by February 15, 2022 in order to receive the Offer. Please note that each software release code is unique per end user and is for one time use only.

You may access the software release code by selecting the “Offers” tab in your Wacom Library. You will then be asked to select your preferred operating system. You will then be provided the option to click “Redeem,” upon which the software release code will be automatically ingested in the redemption link and you will be directed to the Boris FX registration site.

You will need to register with Boris FX in order to receive the Offer. Please note that Boris FX will require that you provide your name, physical address, and email address as part of registering with Boris FX. You may also be required to expressly indicate your acceptance of Boris FX’s Terms of Service and Privacy Policy.

Should you encounter problems with the registration of your Eligible Product or in the event you do not receive a registration confirmation from Wacom despite having completed the registration process, please contact Wacom’s Customer Support Center using the contact form at: http://www.wacom.com/en-us/support.

WACOM SHALL HAVE NO RESPONSIBILITY OR LIABILITY TO YOU OR TO ANY OTHER QUALIFIED PARTICIPANT FOR ANY DELAYED OR FAILED REGISTRATIONS (EITHER WITH WACOM OR WITH BORIS FX), FOR ANY LOST OR INCORRECT SOFTWARE RELEASE CODES, OR FOR ANY DELAYED OR FAILED ACTIVATIONS, NO MATTER THE CAUSE.

PRODUCT RETURNS AND EXCHANGES

If you cancel or return your Eligible Product, regardless of the reason, then you will no longer be eligible to participate in the promotion or receive the Offer, or to otherwise use the Boris FX Suite or exercise the rights granted to you pursuant to the License.

GENERAL TERMS

The Offer is valid only while supplies last and the Eligible Products are subject to availability. The promotion and the Offer are subject to the laws of United States of America, and are void where prohibited or restricted by law. Neither the promotion nor the Offer may be combined with any other Wacom promotions or offers. Wacom is not responsible for any inability to read these Terms and Conditions due to the fact that these Terms and Conditions are in the English language. The Boris FX Suite is owned, managed and/or controlled by Boris FX, and accordingly, you acknowledge and agree that your use of the Boris FX Suite and your registration with Boris FX is subject to the terms and conditions governing the use of the Boris FX Suite and/or your registration with Boris FX, as established, adopted and/or amended by Boris FX from time to time. Wacom is not responsible for the Boris FX Suite or for your registration with Boris FX, and Wacom shall have no responsibility or liability to you or to any other Qualified Purchaser in connection therewith. In particular, Wacom shall have no responsibility or liability to you in the event Boris FX ceases to provide the Boris FX Suite or otherwise terminates or cancels your registration with Boris FX, or for any loss, destruction or other damage you may suffer or incur in connection with your use of the Boris FX Suite and/or your registration with Boris FX. Wacom may use any information provided by you in accordance with its privacy policies posted online at: www.wacom.com/privacy. Should any term of the promotion or these Terms and Conditions be or become completely or partially ineffective, then this will not affect the effectiveness of the remaining conditions; instead of the ineffective conditions, a condition that is legally permissible and has as nearly as possible the effect desired of the ineffective condition shall apply. Wacom reserves the right to end and/or change the promotion and/or the Offer unilaterally and without prior notice to you, including without limitation, the right to change these Terms and Conditions.
