A. Bamboo Paper 앱 - 최종 사용자 라이선스 계약

이 최종 사용자 사용권 계약(이 "계약")은 귀하(소프트웨어를 설치하는 개인 및 그러한 개인을 대표하는 단일 법인체)("귀하" 또는 "귀하의")와 Wacom Co. Ltd(2-510-1 Toyonodai, Kazo-shi, Saitama 349-1148, Japan)("와콤") 사이의 계약입니다.

이 계약을 주의 깊게 읽고 이해해야 합니다. “동의” 버튼을 클릭하거나 소프트웨어를 사용 또는 설치함으로써 귀하는 본 약관의 준수에 동의하게 됩니다. 이 계약의 모든 약관에 동의하지 않거나, 이 계약의 구속을 받는 데 동의하지 않을 경우 귀하의 기기에 있는 "취소" 버튼을 클릭하십시오. 본 약관을 수락하지 않을 경우, 귀하는 소프트웨어를 설치, 사용 또는 액세스할 권한이 없습니다.

1. 정의

1.1"문서"란 소프트웨어의 설치 및 사용을 위한 사용자 가이드와 설명서를 의미합니다.

1.2 “제품”은 소프트웨어와 호환되는 공인 하드웨어 기기의 조합을 의미합니다.

1.3 “소프트웨어”는 기기에서 캡처한 데이터를 다른 목적을 위해서 그리고 다른 앱에서 사용하고 처리할 수 있도록 Wacom이 개발한 소프트웨어 앱 “Bamboo Paper” 및 Wacom이 제공하는 이와 관련된 모든 업데이트를 의미합니다. “소프트웨어”는 제3자 소프트웨어를 의미하거나 포함하지 않습니다.

1.4 “제3자 소프트웨어”는 제5조 제6항에 명시된 소프트웨어 구성 요소(오픈 소스 소프트웨어 포함) 및 관련된 모든 소스 코드 및/또는 문서를 의미합니다.

2. 소프트웨어 라이선스

2.1 라이선스 부여. 본 약관의 조건에 따라 Wacom은 귀하에게 다음과 같은 제한적이고 비독점적인 사용권을 부여합니다: (a) 단일 하드웨어 기기에서 기계 판독 형식을 통해서만 소프트웨어의 단일 복사본을 사용하고 설치할 수 있는 권한; (b) 소프트웨어에 대한 귀하의 승인된 사용을 지원하기 위해 소프트웨어와 함께 제공된 문서를 이용할 수 있는 권한; 및 (c) 소프트웨어의 원본에 포함된 모든 상표, 저작권, 기타 독점적이고 제한된 권리 고지, 범례 및 기호가 백업 복사본에 복제된다는 조건하에, 백업 목적을 위해서만 소프트웨어의 백업 복사본을 만들 수 있는 권한. 상기 사항에도 불구하고, 귀하의 연령이 18세 미만일 경우, 본 계약에 대한 부모 또는 보호자의 동의 없이는 소프트웨어 라이선스가 제공되지 않는다는 사실에 동의합니다.

2.2 제한 사항. 귀하는 본 약관에 명시적으로 허용된 경우 또는 재해 복구, 프로그램 오류 검증, 백업을 목적으로 하는 경우를 제외하고, 제3자로 하여금 소프트웨어(문서 포함)를 복사하거나 사용하도록 허용, 권장 또는 가능하게 하지 않습니다. 귀하는 제3자로 하여금 소프트웨어를 변경, 번역, 배포, 라이선스 재발급, 대여, 임대, 임차 또는 이를 토대로 파생 작업을 생성하거나, 제3자 교육, 상업적 시분할 또는 서비스 접수처 사용을 목적으로 소프트웨어를 사용하도록 허용, 권장 또는 가능하게 하지 않습니다. 이러한 제한에도 불구하고 준거법이 명시적으로 허용하는 경우를 제외하고, 귀하는 제3자로 하여금 소프트웨어를 역설계, 분해 또는 역컴파일하거나, 소프트웨어에 사용 또는 구현된 모든 코드, 알고리즘, 방법 또는 기술을 알아내도록 허용, 권장 또는 가능하게 하지 않습니다. 귀하는 제3자로 하여금 모든 태블릿, 시그니처 패드 또는 본 약관에서 정의된 제품이 아닌 다른 기기와 함께 소프트웨어를 사용하도록 허용, 권장 또는 가능하게 하지 않습니다. 귀하는 소프트웨어에 나타나거나 포함된 모든 상표, 저작권, 기타 독점적이고 제한된 권리 고지, 범례 및 기호를 제거 또는 변경하지 않습니다.

2.3 "수출 제한". 귀하가 소프트웨어를 합법적으로 취득한 국가의 법률이 허용하는 경우를 제외하고, 귀하는 소프트웨어를 사용, 또는 수출 또는 재수출할 수 없습니다. 미국에서 또는 미국으로부터 소프트웨어를 취득한 경우, 소프트웨어를 다음 대상에게 수출 또는 재수출할 수 없습니다: (a) 미국 통상 금지 국가 또는 (b) 미국 재무부의 특별 지정 제재 대상 목록, 또는 미국 상무부의 거래 금지 개인 또는 단체 목록에 등재된 개인. 소프트웨어를 사용함으로써 귀하는 이러한 국가에 있지 않으며 이러한 목록에 등재되어 있지 않음을 보증합니다. 귀하는 제한 없이 핵, 미사일 또는 생화학 무기의 개발, 설계, 제조 또는 생산을 포함하여 미국법이 금지하는 목적을 위해 제품을 사용하지 않을 것에 동의합니다.

2.4 이전 및/또는 일회성 양도 불가. 귀하는 법의 효력에 따라 Wacom의 사전 서 면 동의 없이 소프트웨어 또는 본 약관 상 의 권리 또는 의무를 이전, 양도 또는 위임하지 않습니다. 사전 서 면 동의는 부당하게 보류되어서는 안 됩니다. 그러나 다음 조건을 모두 충족하는 경우, 귀하는 소프트웨어 및 본 계약상의 모든 권리를 제3자에게 1회에 걸쳐 영구히 이전할 수 있습니다: (a) 이전이 소프트웨어가 다운로드되거나 사전 설치된 하드웨어 기기의 이전, 소프트웨어 및 본 계약을 포함하고, (b) 귀하가 소프트웨어의 사본 또는 미디어나 컴퓨터에 소프트웨어 일부를 보유하지 않으며, (c) 소프트웨어를 이전받는 당사자가 본 계약의 조건을 읽고 이해하며 이에 동의하는 경우. 본 계약상의 권리 또는 의무의 이전, 양도 또는 위임은 본 항을 위반할 경우 무효이며 효력이 없습니다.

2.5 소유권. 소프트웨어는 본 약관의 조건을 준수하며 사용하기 위해 귀하에게 사용권이 부여된 것이지 판매된 것이 아닙니다. Wacom 및/또는 계열사 또는 라이선스 부여자는 소프트웨어의 모든 권리, 소유권, 이해관계, 특허, 저작권, 상표, 영업 비밀 및 소프트웨어의 변경, 개선, 업데이트, 파생 작업을 포함하는 모든 지적 재산권 또는 상업소유권을 보유합니다. Wacom은 본 약관에서 명시적으로 귀하에게 부여되지 않은 소프트웨어 관련 권리와 이해관계를 모두 보유하며, 귀하는 본 약관에서 명시적으로 부여된 권리 이외의 명시적 또는 묵시적 권리를 취득하지 않습니다.

2.6 지원 없음. Wacom은 본 약관하에서 기술적 지원, 유지 보수, 업그레이드, 업데이트, 수정 또는 새로운 릴리스를 제공할 의무가 없습니다.

2.7 업데이트. Wacom은 소프트웨어에 대한 업데이트 또는 업그레이드를 임의로 제공할 수 있습니다. 본 약관의 조건은 Wacom에 의해 제공되고 소프트웨어를 대체, 보완, 수정 또는 개선하는 업데이트 또는 업그레이드에 적용됩니다. 그러나 이러한 업그레이드 또는 업데이트에 별도의 조건이 있는 경우는 예외이며 이러한 예외 조건은 본 계약에 추가되는 조건 또는 충돌에 적용됩니다.

3. 보증 및 구제

3.1 제한된 보증.  문서 및 본 계약의 조건을 준수하며 소프트웨어를 사용할 경우, Wacom은 문서에 따라 다음 기간 동안 소프트웨어가 완전히 작동할 것을 보증합니다: (a) 귀하가 유럽, 아프리카 또는 중동에 거주하면 2년의 기간 동안, 또는 (b) 그 외의 지역에 거주하면 구십  (90)일의 기간 동안 보증합니다. 보증 기간은 귀하가 소프트웨어를 처음으로 다운로드한 날짜 또는 소프트웨어가 사전 설치된 경우, 귀하가 제품을 활성화한 날짜로부터 시작합니다(“보증 기간”).  소프트웨어가 보증 기간 중에 앞서 언급한 보증 내용에 부합되지 않을 경우 와콤은 귀하에게 비용을 청구하지 않고 소프트웨어를 수리하거나 교체하는 방식으로 규정 위반 사안을 바로잡기 위해 상업적으로 합당한 수준의 노력을 기울일 것입니다.  소프트웨어의 수리 또는 교체가 실행 가능하지 않고 불균형적이며 적절한 시간 내에 완료될 수 없거나 불합리한 불편을 초래한다고 판단될 경우, Wacom은 수리 또는 교체 대신 귀하가 지불한 비용에 대한 적절한 할인 또는 환불을 제공할 수 있습니다.소프트웨어는 결함 감내 시스템이 아니며, 고위험도 활동과 관련한 사용을 위해 설계, 허용 또는 의도되지 않았습니다. 본 항은 본 약관상 Wacom의 모든 책임과 의무를 명시하고, 소프트웨어가 상기 보증 내용을 준수하지 못할 경우 귀하의 독점적인 구제 방안을 명시합니다. Wacom은 본 약관하에서 다음을 보증하지 않습니다: (A) 소프트웨어가 귀하의 요구사항을 충족시키고, (B) 소프트웨어가 본 약관에 정의된 제품 이외의 모든 제품과 호환되거나, (C) 소프트웨어의 모든 결함이 수정되거나 소프트웨어가 중단 또는 오류 없이 작동한다.본 약관은 모든 제품의 하드웨어 구성품에 대한 Wacom의 보증을 포함하지 않습니다. 이러한 제품은 해당 구성품의 제조사 또는 판매자가 제공하는 별도의 보증이 적용됩니다.소프트웨어의 무단 사용, 남용, 오용, 변경, 방치, 우발적 손상 또는 Wacom이 수행하지 않은 수리 또는 수정에 의해 비준수가 발생할 경우, Wacom은 본 항의 보증 의무를 갖지 않습니다. 소프트웨어의 교체 또는 수리는 최초의 보증 기간을 연장하지 않습니다. Wacom은 제3자 소프트웨어에 대해 보증하지 않습니다. 그러나 귀하가 부분적 또는 전적으로 제3자 소프트웨어로 인해 발생한 심각한 결함을 발견할 경우, Wacom은 제3자 소프트웨어의 라이선스 부여자에게 결함을 보고하도록 노력할 것입니다. Wacom은 라이선스 부여자가 이러한 결함을 해결하기 위해 조치를 취할 것이라는 점을 보장할 수 없습니다. 해당 결함이 보증 기간 내에 Wacom에 보고되고, Wacom이 보증 기간 내에 라이선스 부여자로부터 결함에 대한 해결책을 얻을 수 없을 경우, Wacom은 단독 재량에 따라 귀하가 지불한 비용에 대한 적절한 할인 또는 환불을 제공할 수 있습니다.

3.2 면책조항. Wacom은 이 계약에 포함된 명시적이고 제한적인 보증을 제외하고는 소프트웨어와 관련하여 어떠한 종류의 진술이나 보증을 하지 않습니다. Wacom은 본 약관하에서 소프트웨어와 관련하여 어떠한 종류의 진술 및 보증도 제공하지 않습니다. Wacom은 시장성, 특정 목적 부합, 만족스러운 품질, 정확성 및 비침해와 관련하여 어떠한 종류의 진술 및 보증도 제공하지 않으며, 이행 과정, 거래 과정 또는 거래의 활용에서 발생할 수 있는 어떠한 보증도 제공하지 않습니다. Wacom은 귀하의 제품으로부터 귀하가 전송한 모든 데이터의 정확성을 보증하지 않습니다.

3.3 연락처 정보. 본 약관과 관련된 문의는 먼저 Wacom 고객지원센터에 보내야 합니다:[http://support.wacom.com].

4. 종료

이 계약은 종료될 때까지 유효합니다. 또한, 귀하가 이 계약의 약관을 준수하지 않을 경우 이 계약에 따른 귀하의 권한과 라이선스는 와콤의 통지나 별도의 조치 없이 자동으로 종료되고 무효화됩니다. 본 약관이 종료되면, 귀하는 소프트웨어의 사용을 중단하고, 소프트웨어가 설치된 컴퓨터 및 이와 유사한 기기에서 소프트웨어와 모든 사본(백업 복사본과 모든 문서 포함)을 영구히 삭제하고 복구할 수 없도록 해야 합니다. 본 약관의 종료 시에도 제1조, 제2조 제2항, 제2조 제5항, 제3조 제2항, 제4조 및 제5조는 유효합니다.

5. 일반조항

5.1 법률. 본 약관 및 본 약관과 관련하여 발생하는 모든 사항은 준거법 결정 원칙을 실행하지 않고 일본 국내법의 적용을 받습니다. 본 약관은 국제물품매매계약에 관한 유엔 협약의 적용을 받지 않으며, 이 협약의 적용은 명시적으로 배제되었습니다. 본 약관 또는 소프트웨어와 관련하여 당사자 간에 논란, 클레임 또는 분쟁이 발생할 경우, 이러한 논란, 클레임 또는 분쟁은 일본에 위치한 도쿄 지방 법원에 의해서만 판결을 받을 수 있으며, Wacom과 귀하는 해당 법원의 장소 및 관할권에 대해 확정적으로 동의합니다.

5.2 책임 제한. 당사자 중 일방이 손해의 가능성을 인지하였거나 손해가 예측 가능했을지라도, 계약, 불법행위 또는 기타 이유에 의한 소송에서 당사자 중 일방 또는 제3자에 의해 초래된 모든 간접적, 부수적, 특별, 결과적, 징벌적 손해, 또는 이익, 수익, 사업, 저축, 데이터, 사용의 손실 또는 대체 조달 비용에 대한 손해에 대해 당사자 중 일방은 어떠한 경우에도 책임을 지지 않습니다.

당사자는 본 약관 제5조 제2항 및 기타 조항에 명시된 책임의 제한 및 위험의 배분이 당사자 간에 체결된 협정의 필수 요소임을 인지하며, Wacom은 이러한 규정 없이는 본 약관 계약을 체결하지 않았을 것입니다.

상기 사항에도 불구하고 다음이 발생할 경우, 본 약관의 어떠한 규정도 귀하에 대한 Wacom의 책임을 제한하지 않습니다: (I) Wacom, 직원 또는 대리인의 과실로 인한 사망 또는 신체적 상해; 또는 (II) Wacom, 직원 또는 대리인의 부정행위 또는 부작위; 또는 (III) Wacom의 의도적 또는 중과실 불법 행위에 의해 발생하거나 (IV) 의무적인 제조물 책임법하에서 발생 할 경우.

5.3 가분성. 본 약관의 조항이 불법, 무효 또는 시행불능인 경우, 이러한 조항은 당사자들의 명시된 의도와 일치하는 정도까지 시행되거나, 이러한 시행이 불가능한 경우 본 약관에서 분리되어 삭제된 것으로 간주되며, 본 약관의 나머지 조항은 효력을 계속 유지합니다.

5.4 법률 준수. 귀하는 귀하가 거주하고 있는 국가나 지역 또는 소프트웨어를 다운로드하거나 사용하는 국가나 지역의 수출법과 현지법을 포함하여 모든 해당 법률 및 규정을 완벽하게 준수합니다. 귀하는 앞서 언급한 내용의 일반성을 한정하지 않고 귀하의 대표자가 해당 법률에서 제한하거나 금지하는 대상, 개인 또는 주체에 소프트웨어 또는 직접 제품을 수출, 전송 또는 이전하지 않도록 합니다.

5.5 전체 계약, 일반. 본 약관은 당사자 간의 완전 합의를 구성하며, 본 약관의 주제와 관련하여 서면 또는 구두로 작성된 이전 또는 현재의 모든 계약 또는 진술을 대체합니다. 본 약관은 귀하와 Wacom 사이에 제휴, 합작 투자, 고용주-고용인, 대리 또는 본부-가맹점 관계를 형성하지 않으며 그렇게 해석되어서도 안 됩니다. 본 약관에 포함된 제목, 머리말 또는 각 조의 제목은 편의상 삽입되었을 뿐이며, 어떠한 경우에도 본 약관의 조항을 정의하거나 설명하지 않습니다. 이 계약의 불이행 또는 위반에 따른 당사자의 권리 포기는 서면으로만 이루어질 수 있으며 기타 또는 이후의 계약 불이행 또는 위반에 대한 권리 포기로 간주되지는 않습니다.

5.6 오픈 소스 소프트웨어를 비롯한 제3자 소프트웨어의 포함. 제3자 소프트웨어는 아래에 그리고 Bamboo Paper 앱의 설정 중 “소개” 메뉴의 “제3자 라이선스”에 열거되어 있으며, Bamboo Paper 앱을 설치하면 함께 설치되거나 사전에 설치되어 있고 Bamboo Paper 앱을 실행하면 사용할 수 있습니다.

5.7 라이선스 공지 및 제3자 소프트웨어의 계약 조건. 모든 제3자 소프트웨어는 본 계약의 상기 조항에 추가로 또는 이에 대신하여 적용되는 별도의 라이선스 계약 조건의 적용을 받거나 받을 수 있습니다. 귀하는 C 절에 명시된 제3자 소프트웨어에 적용되는 별도의 라이선스 계약 조건을 읽고 검토해야 합니다. 본 계약의 상기 조항과 C 절의 이용 약관 내용이 상충하는 경우, 제3자 소프트웨어에 적용되는 C 절에 명시된 이용 약관이 우선시됩니다. 본 계약에 대한 귀하의 수락은 제3자 소프트웨어에 적용되는 라이선스 계약 조건의 수락을 구성합니다.

All of the deliverable code in SQLite has been dedicated to the public domain by the authors. All code authors, and representatives of the companies they work for, have signed affidavits dedicating their contributions to the public domain and originals of those signed affidavits are stored in a firesafe at the main offices of Hwaci. Anyone is free to copy, modify, publish, use, compile, sell, or distribute the original SQLite code, either in source code form or as a compiled binary, for any purpose, commercial or non-commercial, and by any means.

The previous paragraph applies to the deliverable code in SQLite - those parts of the SQLite library that you actually bundle and ship with a larger application. Portions of the documentation and some code used as part of the build process might fall under other licenses. The details here are unclear. We do not worry about the licensing of the documentation and build code so much because none of these things are part of the core deliverable SQLite library.

All of the deliverable code in SQLite has been written from scratch. No code has been taken from other projects or from the open internet. Every line of code can be traced back to its original author, and all of those authors have public domain dedications on file. So the SQLite code base is clean and is uncontaminated with licensed code from other projects.
