A. Bamboo Paper App – Endbenutzer-Lizenzvertrag

Diese Endbenutzer-Lizenzvereinbarung (diese „Vereinbarung”) besteht zwischen Ihnen (sowohl die natürliche bzw. Einzelperson, die die Software installiert, als auch die juristische Person bzw. das Unternehmen, für die/das diese Einzelperson handelt) („Sie/Ihnen" oder „Ihr(e)“) und der Wacom Co. Ltd, 2-510-1 Toyonodai, Kazo-shi, Saitama 349-1148, Japan („Wacom“).

ES IST WICHTIG, DASS SIE DIESE VEREINBARUNG SORGFÄLTIG LESEN UND VERSTEHEN. DURCH ANKLICKEN DES „ZUSTIMMEN"-BUTTONS ODER DURCH NUTZUNG ODER INSTALLATION DER SOFTWARE STIMMEN SIE ZU, AN DIESE VEREINBARUNG GEBUNDEN ZU SEIN. SOLLTEN SIE NICHT ALLEN BESTIMMUNGEN DIESER VEREINBARUNG ZUSTIMMEN ODER NICHT DAMIT EINVERSTANDEN SEIN, DURCH DIESE VEREINBARUNG GEBUNDEN ZU SEIN, KLICKEN SIE BITTE AUF DEN „ABBRECHEN"-BUTTON IHRES GERÄTS. FALLS SIE DIESER VEREINBARUNG NICHT ZUSTIMMEN, HABEN SIE KEIN RECHT, DIE SOFTWARE ZU INSTALLIEREN, ZU NUTZEN ODER AUF DIESE ZUZUGREIFEN.

1. Begriffsbestimmungen

1.1 „Dokumentationen“ sind die Benutzerleitfäden und -handbücher zur Installation und Nutzung der Software.

1.2 „Produkt“ steht für die Verbindung eines autorisierten Hardware-Geräts, mit dem die Software als kompatibel konzipiert wurde.

1.3 „Software“ steht für die Software-App „Bamboo Paper“, die von Wacom entwickelt wurde und die es Ihnen ermöglicht, Daten auf Ihrem eigenen Hardware-Gerät zu speichern, damit Sie in der Lage sind, sie (diese App) für andere Zwecke in anderen Anwendungen und etwaigen verwandten, Ihnen gelieferten oder Ihnen seitens Wacom zur Verfügung gestellten Updates der beiden vorher genannten zu verwenden und zu verarbeiten. "Software" bedeutet keine Dritt-Software und schließt diese auch nicht mit ein.

1.4 „Dritt-Software“ umfasst die Software-Komponenten (einschließlich Open Source Software) wie in Paragraph 5.6 aufgeführt, und dazu gehörige Quellcodes und/oder Dokumentationen.

2. Software-Lizenz

2.1 Lizenzerteilung. Vorbehaltlich der Bedingungen dieser Vereinbarung erteilt Wacom Ihnen hiermit eine beschränkte, nicht ausschließliche Lizenz dazu: (a) eine einzelne Kopie der Software, nur in maschinenlesbarer Form, auf einem einzelnen Hardware-Gerät zu nutzen und dort zu installieren; (b) die mit der Software zur Unterstützung Ihrer autorisierten Nutzung der Software mitgelieferte Dokumentation zu nutzen; und (c) eine einzelne Back-up-Kopie der Software anzufertigen, die allein zu Back-up-Zwecken verwendet werden darf –vorausgesetzt, dass sämtliche Warenzeichen, Urheberrechte und sonstigen eigentumsrechtlich geschützten und beschränkten Rechtsanmeldungen, Legenden und Symbole, die in der Originalversion der Software enthalten sind, auf dieser Back-up-Kopie reproduziert werden. Ungeachtet des Vorangehenden, stimmen Sie zu, dass Ihnen, wenn Sie unter 18 Jahre alt sind, keine Lizenz für die Software ohne die Zustimmung Ihrer Eltern oder Ihres Vormunds zu dieser Vereinbarung angeboten oder bereitgestellt wird.

2.2 Einschränkungen. Sie werden die Software (einschließlich der Dokumentation) außer wie es ausdrücklich nach dieser Vereinbarung keinen Dritten oder dazu - oder außer für die Notfallwiederherstellung (disaster recovery), die Programmfehleranalyse oder zu Back-up-Zwecken. Sie werden die Software keinen Dritten oder dazu nicht verändern, übersetzen, verbreiten, davon schöperisch abgeleitete Werke aufgrund der Software erstellen, diese verpfänden, diese weiter lizensieren, oder eine Unterlizenz erteilen, sie verleihen, vermieten oder verpachten oder die Software für die Schulung Dritter, ein gewerbsmäßiges Time-Sharing oder für Büroservice-Zwecke verwenden. Sie werden die Software keinen Dritten oder dazu – nicht zurückentwickeln (kein Reverse-Engineering vornehmen), auseinander nehmen oder dekompilieren oder nicht versuchen, Quellcodes, Algorithmen, Methoden oder technische Verfahren, die in der Software verwendet werden oder darin enthalten sind, bestimmen, außer sofern und soweit es nach geltendem Recht trotz dieser Einschränkung erlaubt ist. Sie werden die Software keinen Dritten oder dazu – nicht in Verbindung mit einem Tablet-, Signatur-Pad oder sonstigem Gerät, das nicht als Produkt in dieser Vereinbarung definiert ist, verwenden. Sie werden keinerlei Warenzeichen, Urheberrechte oder sonstige eigentumsrechtlich geschützte und eingeschränkte Rechteanmeldungen, Legenden und Symbole, die in oder auf der Software erscheinen, entfernen oder abändern.

2.3 „Ausfuhr-/Exportbeschränkungen“. Sie dürfen die Software, außer im Rahmen der gesetzlichen Bestimmungen des Landes, in dem Sie die Software rechtmäßig erworben haben, weder ausführen noch weiter ausführen. Sollten Sie die Software in oder aus den Vereinigten Staaten erworben haben, darf die Software nicht ausgeführt oder weiter ausgeführt werden (a) in ein Land, das einem US-Exportembargo unterliegt, oder (b) an jemanden, der auf einer speziellen Verbotsliste des US-Finanzministerium für bestimmte Staatsangehörige (Specially Designated Nationals) oder einer Liste des US-Handelsministerims für geächtete Personen oder Unternehmen (Denied Person’s List or Entity List) steht. Durch Nutzung der Software sichern Sie zu und garantieren, dass Sie nicht in einem solchen Land ansässig sind oder auf einer solchen Liste stehen. Sie verpflichten sich auch dazu, diese Produkte zu keinen nach dem Recht der USA verbotenen Zwecken zu verwenden, insbesondere nicht zur Entwicklung, Konstruktion, Herstellung oder Produktion von Atomraketen oder nuklearen, chemischen oder biologischen Waffen.

2.4 Keine Abtretung; einmalige Übertragung. Sie dürfen die Software oder etwaige Ihrer Rechte und Pflichten nach dieser Vereinbarung ohne die vorherige schriftliche Zustimmung (Einwilligung) von Wacom, die nicht ohne triftigen Grund zu versagen ist, kraft Gesetzes oder aus sonstigen Gründen nicht übertragen, abtreten oder delegieren. Sie dürfen jedoch eine einmalige dauerhafte Rechtsübertragung der Software und all Ihrer Rechte nach dieser Vereinbarung an einen anderen vornehmen, wenn – aber nur wenn – alle folgenden Bedingungen erfüllt sind: (a) die Übertragung umfasst die Übertragung des Hardware-Geräts, auf dem die Software heruntergeladen oder vorinstalliert wurde, und umfasst die Software und diese Vereinbarung, (b) Sie behalten keine Kopien der Software oder von Teilen davon auf einem Medienträger oder Rechner zurück, und (c) die die Software empfangende Person liest, versteht und verpflichtet sich, die Bedingungen dieser Vereinbarung zu akzeptieren. Jede Übertragung, Abtretung oder Delegation von etwaigen Ihrer Rechte oder Pflichten nach dieser Vereinbarung, die unter Verstoß gegen diesen Absatz erfolgt, ist nichtig und unwirksam.

2.5 Inhaberschaft/Eigentum. Die Software wird an Sie lizensiert (d.h. eine diesbezügliche Lizenz erteilt), nicht verkauft – und Ihnen zur Nutzung überlassen, und zwar allein nach den Bedingungen dieser Vereinbarung. Wacom und/oder ihre Verbundunternhemen oder Lizenzgeber behalten alle Rechte, Ansprüche und Eigentumsrechte an und hinsichtlich der Software, sowie alle Patente, Urheberrechte, Warenzeichen, Geschäftsgeheimnisse, und sonstigen geistigen Eigentumsrechte oder gewerblichen Schutzrechte an der Software, einschließlich etwaiger Änderungen, Verbesserungen, Updates dazu und davon abgeleiteter Werke. Wacom behält sich alle Ansprüche und Eigentumsrechte an der Software, die Ihnen nicht ausdrücklich nach dieser Vereinbarung erteilt wurden, vor, und Sie erwerben keine anderen Rechte, ausdrücklich oder konkludent, an der Software außer den Ihnen nach dieser Vereinbarung ausdrücklich gewährten Rechten.

2.6 Keine Unterstützung. Wacom trifft keine Pflicht, nach dieser Vereinbarung Hilfsleistungen wie technischen Support, Wartung, Upgrades, Updates, Änderungen oder Neuherausgaben zu gewähren.

2.7 Updates. Wacom kann Ihnen nach eigenem Ermessen Updates oder Upgrades zur Software zukommen lassen. Die Bedingungen dieser Vereinbarung bestimmen auch die Ihnen von Wacom gelieferten Updates oder Upgrades, die die Software ersetzen, ergänzen, ändern oder erweitern, außer wenn einem solchen Upgrade oder Update gesonderte Bedingungen beiliegen, die in diesem Fall dann insoweit gelten, als es zu Widersprüchen mit dieser Vereinbarung kommt oder als sie als zusätzliche Bedingungen zu dieser Vereinbarung hinzutreten.

3. Gewährleistungsansprüche und sonstige Rechtsbehelfe

3. Gewährleistungsansprüche und sonstige Rechtsbehelfe 3.1 Eingeschränkte Garantien. Wacom garantiert, dass die Software, wenn sie in Übereinstimmung mit der Dokumentation und nach Maßgabe der Bedingungen dieser Vereinbarung verwendet wird, im Wesentlichen der vertraglichen Leistungsbeschreibung nach der Dokumentation über einen Zeitraum von (a) 2 Jahren entspricht, wenn Sie in Europa, Afrika oder dem Nahen Osten wohnhaft sind, oder (b) neunzig (90) Tagen, wenn Sie in anderen Ländern wohnen – gerechnet ab dem Zeitpunkt, an dem die Software von Ihnen zum ersten Mal heruntergeladen wird, oder wenn die Software vorher bereits auf Ihr Produkt geladen war, ab dem Zeitpunkt, an dem das Produkt von Ihnen aktiviert wird ("Gewährleistungsfirst"). Für den Fall, dass die Software der vorgenannten Garantie während dieser Gewährleistungsfirst nicht entspricht, unternimmt Wacom wirtschaftlich vertretbare Anstrengungen, um die Abweichung von der Leistungsbeschreibung zu beheben (bzw. den entsprechenden Mangel zu beseitigen) durch Reparatur oder Ersatz der Software, ohne dass Ihnen hierfür Kosten belastet würden. Sollte Wacom entscheiden, dass eine Reparatur oder ein Ersatz der Software nicht machbar ist, unverhältnismäßig teuer wäre, nicht innerhalb vertretbarer Zeit erledigt werden könnte oder mit unzumutbaren Nachteilen verbunden wäre, kann Wacom statt einer Reparatur oder eines Ersatzes eine angemessene Preisminderung oder Rückerstattung der von Ihnen gezahlten Entgelte anbieten.
DIE SOFTWARE IST NICHT FEHLERTOLERANT UND IST NICHT FÜR VERWENDUNGSZWECKE KONZIPIERT, GESTATTET ODER VORGESEHEN, DIE MIT HOCHRISKANTEN AKTIVITÄTEN VERBUNDEN SIND. DIESER ABSATZ SETZT DIE GESAMTE HAFTUNG UND VERPFLICHTUNG VON WACOM NACH DIESER VEREINBARUNG FEST SOWIE IHREN AUSSCHLIESSLICHEN RECHTSBEHELF (GEWÄHRLEISTUNGSANSPRUCH) FÜR DEN FALL, DASS DIE SOFTWARE NICHT DER VORGENANNTEN GARANTIE ENTSPRICHT. WACOM GARANTIERT NACH DIESER VEREINBARUNG JEDOCH NICHT: DASS (A) DIE SOFTWARE IHREN ANFORDERUNGEN (ALS NUTZER) ENTSPRICHT, (B) DIE SOFTWARE MIT JEDWEDEM PRODUKT KOMPATIBEL IST ODER MIT DIESEM LÄUFT (BETRIEBEN WERDEN KANN), DAS NICHT ALS EIN PRODUKT IM SINNE DIESER VEREINBARUNG DEFINIERT IST, ODER (C) SÄMTLICHE MÄNGEL AN DER SOFTWARE BEHOBEN WERDEN, ODER DASS DIE SOFTWARE STETS UNUNTERBROCHEN STÖRUNGS- ODER FEHLERFREI LÄUFT.
Diese Vereinbarung enthält keinerlei Garantie- oder Gewährleistungsansprüche von Wacom für Hardware-Komponenten irgendwelcher Produkte, die separaten Garantien von Herstellern oder Verkäufern (Händlern) dieser Komponenten unterliegen.
WACOM TRIFFT KEINE GEWÄHRLEISTUNGSPFLICHTEN NACH DIESEM ABSATZ, WENN DIE ABWEICHUNG VON DER LEISTUNGSBESCHREIBUNG (GEMÄSS SOFTWARE-DOKUMENTATION) DURCH UNBEFUGTE NUTZUNG DER SOFTWARE, MISSBRAUCH, FEHLGEBRAUCH, ABÄNDERUNG, FAHRLÄSSIGEN ODER ZUFÄLLIGEN SCHADEN DER SOFTWARE ODER INFOLGE EINER SEITENS WACOM NICHT DURCHFÜHRTEN (UNTERLASSENEN) REPARATUR ODER ÄNDERUNG DER SOFTWARE EINTRITT. DER ERSATZ ODER DIE REPARATUR DER SOFTWARE VERLÄNGERT NICHT DIE GEWÄHRLEISTUNG FRIST ÜBER DIE GEWÄHRLEISTUNG FRIST GEWÄHRLEISTUNGSFRIST HINAUS. WACOM GIBT KEINE GARANTIE FÜR IRGENDEINE SOFTWARE DRITTER. Wenn Sie allerdings einen schweren Mangel feststellen sollten, der ganz oder teilweise durch Software Dritter verursacht wurde oder dieser zurechenbar ist, bemüht sich Wacom, diesen Mangel an den Lizenzgeber der Dritt-Software zu melden zwecks möglicher Abhilfe Handlungen. Wacom kann nicht zusichern, dass der Lizenzgeber Abhilfe Handlungen zur Beseitigung dieses Mangels ergreifen wird. Wenn dieser Mangel Wacom innerhalb der Gewährleistungsfrist gemeldet wird und Wacom nicht in der Lage ist, eine Lösung in Bezug auf den Mangel seitens des Lizenzgebers der Dritt-Software innerhalb dieser Gewährleistungsfrist herbeizuführen, kann Wacom nach eigenem Ermessen eine angemessene Preisminderung oder Rückerstattung der von Ihnen gezahlten Entgelte anbieten.

3.2 Haftungsausschluss. Außer den ausdrücklichen, beschränkten Gewährleistungen, wie sie in dieser Vereinbarung enthalten sind, GIBT WACOM KEINE ANDEREN GARANTIEN JEGLICHER ART IN BEZUG AUF DIE SOFTWARE UND SCHLIESST JEDWEDE HAFTUNG HIERFÜR AUS. NACH DIESER VEREINBARUNG GIBT WACOM KEINERLEI ZUSICHERUNGEN ODER GARANTIEN JEGLICHER ART IN BEZUG AUF DIE HANDELSÜBLICHKEIT, BESCHAFFENHEIT ZU EINEM BESTIMMTEN ZWECK, ZUFRIEDENSTELLENDE QUALITÄT, RICHTIGKEIT UND DIE NICHTVERLETZUNG SOWIE ETWAIGE GEWÄHRLEISTUNGEN AUS ODER IM RAHMEN DER VERTRAGLICHEN LEISTUNG, EINER GESCHÄFTSGEPFLOGENHEIT ODER EINES HANDELSBRAUCHS. WACOM GARANTIERT NICHT DIE RICHTIGKEIT VON DATEN, DIE SIE VON IHREM PRODUKT ÜBERTRAGEN HABEN.

3.3 Kontaktdaten. Korrespondenz bezüglich oder aus dieser Vereinbarung ist grundsätzlich an den Erstkontakt-Wacom-Kundenbetreuungsdienst unter [http://support.wacom.com] zu richten.

4. Vertragsbeendigung

Diese Vereinbarung läuft solange, bis sie gekündigt wird. Darüber hinaus enden und erlöschen Ihre Rechte und Lizenzen im Rahmen dieses Vertrages automatisch, ohne dass irgendeine Mitteilung oder Maßnahme durch Wacom erforderlich ist, für den Fall, dass Sie gegen Bestimmungen dieses Vertrages verstoßen. Mit Kündigung bzw. Beendigung dieser Vereinbarung haben Sie sämtliche Nutzung der Software einzustellen und diese sowie alle Kopien der Software (einschließlich Ihrer Back-up-Kopie und sämtlicher Dokumentation) dauerhaft von Ihrem Rechner und sonstigen ähnlichen Geräten, auf denen diese installiert war, zu löschen und nicht mehr wiederherstellbar zu machen. Bei jedweder Beendigung dieser Vereinbarung gelten die Paragraphen 1, 2.2, 2.5, 3.2, 4 und 5 auch über das Vertragsende hinaus weiter.

5. Allgemeine Bestimmungen

5.1 Geltendes Recht. Diese Vereinbarung und sämtliche sich daraus ergebenden oder damit im Zusammenhang stehenden Angelegenheiten richten sich nach dem (internen) materiellen Recht Japans ohne Anwendung einer Rechtswahlmöglichkeit (nach internationalem Privatrecht). Diese Vereinbarung unterliegt nicht dem UN-Kaufrechtsübereinkommen (United Nations Convention on Contracts for the International Sales of Goods, CISG), deren Geltung ausdrücklich ausgeschlossen wird. Im Falle einer Meinungsverschiedenheit, eines geltend gemachten Anspruchs oder Streits zwischen den Parteien aus oder im Zusammenhang mit dieser Vereinbarung oder der Software, kann diese Meinungsverschiedenheit, dieser geltend gemachte Anspruch oder Streit nur vor dem Bezirksgericht Tokio (Tokyo District Court), gelegen in Japan, gerichtlich entschieden werden, und Wacom und Sie erteilen hiermit unwiderruflich ihr/Ihr Einverständnis mit diesem Gerichtsstand.

5.2 Haftungsbeschränkung. IN KEINEM FALL HAFTET EINE PARTEI FÜR ETWAIGE INDIREKTE, ZUFÄLLIGE, BESONDERE, FOLGE- ODER ZIVILSTRAFEN BEINHALTENDE SCHÄDEN ODER SCHÄDEN AUFGRUND ENTGANGENEN GEWINNS, ENTGANGENER EINNAHMEN, GESCHÄFTSCHANCEN, ERSPARNISSE, VERLOREN GEGANGENER DATEN, ENTGANGENER NUTZUNG ODER AUFGRUND DER KOSTEN FÜR ERSATZBESCHAFFUNG, DIE VON EINER DER VERTRAGSPARTEIEN ODER VON DRITTEN ERLITTEN WORDEN SIND, WEDER AUFGRUND VERTRAGLICHER NOCH GESETZLICHER (DELIKTISCHER) ANSPRÜCHE IM RAHMEN EINER KLAGE AUS VERTRAGSVERLETZUNG ODER AUS UNERLAUBTER HANDLUNG NOCH NACH SONSTIGEN RECHTSINSTITUTEN, SELBST WENN DIE ANDERE PARTEI AUF DIE MÖGLICHKEIT DES EINTRITTS SOLCHER SCHÄDEN HINGEWIESEN WORDEN IST ODER DIE SCHÄDEN VORHERSEHBAR WAREN.

DIE PARTEIEN ERKENNEN AN, DASS DIE FÄLLE DER HAFTUNGSBESCHRÄNKUNG NACH DIESER KLAUSEL 5.2 UND NACH DEN ANDEREN BESTIMMUNGEN DIESER VEREINBARUNG UND DIE RISIKOVERTEILUNG WESENTLICHE ELEMENTE BEI DER AUSHANDLUNG DES RECHTSGESCHÄFTS ZWISCHEN DEN PARTEIEN WAREN, OHNE DIE WACOM DIESE VEREINBARUNG NICHT ABGESCHLOSSEN HÄTTE.

ABWEICHEND VON DER OBIGEN REGELUNG BESTEHT NACH DIESER VEREINBARUNG JEDOCH KEINERLEI HAFTUNGSBESCHRÄNKUNG VON WACOM IHNEN GEGENÜBER IM FALLE: DES (I) TODES ODER DER KÖRPERVERLETZUNG, SOFERN UND SOWEIT DURCH FAHRLÄSSIGKEIT VON WACOM ODER IHRER MITARBEITER ODER VERTRETER VERURSACHT; ODER (II) EINES ARGLISTIGEN HANDELNS ODER UNTERLASSENS VON WACOM ODER IHRER MITARBEITER ODER VERTRETER; ODER (III) SOWEIT AUS VORSÄTZLICHEM ODER GROB FAHRLÄSSIGEM FEHLVERHALTEN SEITENS WACOM RESULTIEREND ODER (IV) NACH ZWINGENDEN PRODUKTHAFTUNGSRECHTLICHEN VORSCHRIFTEN.

5.3 Salvatorische Klausel. Sollte eine Bestimmung dieser Vereinbarung für rechtswidrig, ungültig oder sonst wie rechtlich nicht durchsetzbar befunden werden, wird diese Bestimmung soweit durchgesetzt wie möglich, um der festgestellten Absicht der Vertragsparteien gerecht zu werden, oder falls deren Durchsetzung nicht möglich ist, gilt die Bestimmung als von dieser Vereinbarung abgetrennt und gestrichen, während der Rest der Vereinbarung vollständig in Kraft bleibt und seine Wirksamkeit behält .

5.4 Rechtskonformität. Sie halten sich vollumfänglich an alle geltenden gesetzlichen und verwaltungsrechtlichen Bestimmungen, einschließlich Ausfuhrgesetzen und lokaler Rechte des Landes oder der Region, in dem/der Sie wohnen oder in dem/der Sie die Software herunterladen oder nutzen. Sie werden nicht, und insbesondere dürfen Sie von Ihren Vertretern nicht verlangen, die Software oder jedes direkte davon abgeleitete Produkt an einen Zielort, eine Person oder ein Unternehmen zu exportieren, zu richten oder dorthin zu übertragen, der/die/oder das nach geltendem Recht beschränkt oder verboten ist.

5.5 Ganze Vereinbarung; Allgemeines. Diese Vereinbarung stellt die gesamte (vertragliche) Vereinbarung zwischen den Parteien dar und ersetzt alle vorherigen oder gegenwärtigen Vereinbarungen oder Absprachen, schriftlich oder mündilch, zum zugrundeliegenden Gegenstand dieser Vereinbarung. Diese begründet, und ist als solche auch nicht auszulegen, keinerlei Partnerschaft, Joint Venture, abhängiges Beschäftigungsverhältnis (zwischen Arbeitgeber und Arbeitnehmer), Vertreter- bzw. Agenturverhältnis oder Franchising-Verhältnis (zwischen Franchisegeber und Franchisenehmer) zwischen Ihnen und Wacom. Jede Überschrift, Legende oder Klausel Bezeichnung nach dieser Vereinbarung wurde nur um der besseren Lesbarkeit willen gesetzt oder eingefügt, und definiert oder erläutert auf keinen Fall diese Klausel oder Bestimmung in inhaltlich maßgeblicher Hinsicht. Jeglicher Verzicht seitens einer Partei auf Geltendmachung von Ansprüchen auf Verzug oder Vertragsverletzung aus dieser Vereinbarung kann nur schriftlich im Einzelfall gemacht werden und stellt keinen Verzicht auf die Geltendmachung nachfolgender Verzugs- oder Vertragsverletzungsansprüche dar.

All of the deliverable code in SQLite has been dedicated to the public domain by the authors. All code authors, and representatives of the companies they work for, have signed affidavits dedicating their contributions to the public domain and originals of those signed affidavits are stored in a firesafe at the main offices of Hwaci. Anyone is free to copy, modify, publish, use, compile, sell, or distribute the original SQLite code, either in source code form or as a compiled binary, for any purpose, commercial or non-commercial, and by any means.

The previous paragraph applies to the deliverable code in SQLite - those parts of the SQLite library that you actually bundle and ship with a larger application. Portions of the documentation and some code used as part of the build process might fall under other licenses. The details here are unclear.
